Invoking Sandy Hook, California seeks 'Ammunition Purchase Permits' "for the sake of our children"

Invoking the Sandy Hook massacre, a California lawmaker has proposed the enactment of "Ammunition Purchase Permits" in the state "for the sake of our children", requiring all buyers of ammo to be issued a special annual permit before their purchase is approved. SB-53 Ammunition: purchase permits.(2013-2014) was introduced by CA State Senator Kevin De Leon, a Democrat who represents the 22nd district of Los Angeles. "For the sake of our children and the memory of the victims of the Sandy Hook massacre, it's time for an honest and rationale debate on gun control and how to keep ammunition out of the hands of criminals", De Leon says.

De Leon's past gun legislation was signed into law by anti-gun governor Arnold Schwarzenegger (who had ironically been lauded by Republicans as the best choice) and praised by Chief William Bratton, an admitted freemason. De Leon's press release immediately invokes the "Sandy Hook" massacre as justification for this proposal. In his press conference video entitled Senator De Leon Announces Legislation to Keep Ammo out of the Wrong Hands, De Leon states in part "for too long, too much ground has been ceded in this debate.... we must not capitulate any longer. I for one have had it." He claims that he has no interest in preventing law abiding citizens from buying ammunition, but rather to prevent the mentally ill and criminals from buying it. However, in the case of the Sandy Hook massacre, which is the pretext under which he has proposed this law, the bullets weren't even alleged to have been bought by a criminal or mental patient, but rather were purchased 100% legally by the mother of the assailant. He states that under the proposed law people will be required to "pass an extensive background check" before buying ammo, "much of which is principally desgined to kill people" and concludes with "the victims of Newtown deserve much better."

All up to date information regarding this bill can be found by visiting and typing in SB 53 in the top right corner search box. The last official action according to the state's legislative website was on 12/21/12, which states that the bill "May be acted upon on or after January 20."

The principal coauthor of the bill is Senator Leland Yee Ph.D., a child psychologist from China, along with additional coauthors Senator Darrell Steinberg, a Jewish lawyer, and Assemblywoman Nancy Skinner. Skinner is described as a "environmental activist" who founded a coalition "to assist urban regions with environmental and global warming policy". Like De Leon, Skinner also invokes the Newtown shooting as well as the Aurora, Colorado shooting on her official website, stating "In California, it's harder to get some cold medicines than ammunition. Something has to change." Skinner had previously introduced legislation (AB2512) which would have "required large ammunition purchases to be reported to local law enforcement" as well as banned "high-capacity magazines".

Two of the coauthors, Yee and Steinberg both voted to support De Leon's insane proposal to outlaw flat sheets in California hotels in 2011, an idea which was mocked worldwide as an example of out-of-control nanny government. The bill, SB 432, "died" in Appropriations Committee "without further action" from the Assembly. SB 432, "an act to add Section 6714 to the Labor Code, relating to workplace safety" was peddled by De Leon who had complained "my mother was a housekeeper and worked herself to the bone".

SB 53 if passed would commence on June 1, 2014 and would require permits, associated fees, as well as "the brand, type, and amount of ammunition sold or otherwise transferred" and the purchaser's signature, thumbprint, full residential address, and date of birth. All applying would be thoroughly checked by the "State Department of Mental Health" and the permit, if issued, will contain a "unique identifying number, expiration date from the date of issuance, physical characteristics, including the height, weight, eye color, and hair color of the permitholder, and other information that may be prescribed by the department."

In October 2011, De Leon convened "a community meeting to examine California's role as a pipeline for guns and ammunition to the Mexican drug cartels and how to improve efforts to stem such gun and ammunition trafficking," which featured "Testimony from Tijuana Police Chief, Several Central American Governments and State, Federal and Local Law Enforcement." No word from De Leon whatsoever on the Fast and Furious scandal, in which the very feds he lauds shipped drugs and guns into Mexico which have already killed many people including law enforcement officers.

De Leon's personal campaign website claims "Studies show that communities enjoy lower rates of crime, unemployment, poverty, and school dropouts when they provide ample park space for their residents" and notes that he "Authored a bill to keep handgun ammunition out of the hands of gang members and criminals. The measure was championed by former LAPD Chief William Bratton and Sheriff Lee Baca to make our streets more secure."

Anthony J. Portantino, the Democrat who wrote the 2011 bill which outlawed open carry of handguns in California, had just returned from a "Legislative Study Trip to Israel" prior to introducing the bill. While none of the co-authors of SB53 are listed as those who've gone on such a trip, Coauthor Darrell Steinberg is featured on the Jewish Public Affairs Committee of California's website. De Leon himself has spoken to the American Jewish Committee (AJC), which advocates "Global Jewish Advocacy" on their website. SACRAMENTO Expressing a resolve to help stem the continued outbreak of gun violence, and combat the easy accessibility to firearm ammunition, Senator Kevin de Leon (D-Los Angeles) announced legislative plans to require anyone wishing to purchase ammunition in California to first obtain a California Ammunition Purchase Permit issued by the Department of Justice, valid for one year from the date of issuance. To obtain such a permit, the holder will have to pass a background check.

"For the sake of our children and the memory of the victims of the Sandy Hook massacre, it's time for an honest and rationale debate on gun control and how to keep ammunition out of the hands of criminals," said Senator De Leon. California has enacted legislation designed to keep guns out of the hands of criminals, but it has virtually no laws governing who can sell and buy ammunition The only significant law on the topic, AB 962 (De Leon) The Anti-Gang Neighborhood Protection Act covering handgun ammunition was signed by Governor Schwarzenegger in 2009, but has been tied up in court by the NRA who's arguing there is no such thing as handgun ammunition. Senator De Leon emphasized that the state requires a license to hunt and a license to fish, and you are even required to have a permit to cut down a Christmas tree - yet, thanks to the NRA, we have nearly unfettered access to any amount of ammunition. The estimated cost of the proposed ammunition permit will be approximately $50.00; by comparison a sport fishing license is $45.93. The legislation would require a vendor of ammunition to verify that a person who is being delivered ammunition is the holder of a valid ammunition purchase permit. ...This legislation requiring ammunition purchasers to obtain purchase permits and submit to background checks for all types of ammunition would render the NRA challenge Parker v. California case moot, giving law enforcement critical information about who is buying ammunition in their jurisdiction and ensuring that purchasers have passed a background check within the past year."

The bill would, commencing June 1, 2014, authorize issuance of ammunition purchase permits by the Department of Justice to applicants who are residents of this state, at least 18 years of age, not prohibited from acquiring or possessing ammunition, and who pay the required fees, as specified. A vendor shall not sell or otherwise transfer ownership of any handgun ammunition without, at the time of delivery, legibly recording the following information:
(1) The date of the sale or other transaction.
(2) The purchaser's or transferee's driver's license or other identification number and the state in which it was issued.
(3) The brand, type, and amount of ammunition sold or otherwise transferred.
(4) The purchaser's or transferee's signature.
(5) The name of the salesperson who processed the sale or other transaction.
(6) The right thumbprint of the purchaser or transferee on the above form.
(7) The purchaser's or transferee's full residential address and telephone number.
(8) The purchaser's or transferee's date of birth.


(c) (1) Upon receipt of an initial or renewal application, the department shall examine its records and is authorized to request records from the State Department of Mental Health, pursuant to Section 8104 of the Welfare and Institutions Code, and if authorized, the National Instant Criminal Background Check System, as described in of Section 922(t) of Title 18 of the United States Code, in order to determine if the applicant is prohibited from possessing or acquiring ammunition. (2) The applicant shall be approved or denied within 30 days of the date of the application. If the application is denied, the department shall state the reasons for doing so and provide the applicant an appeal process to challenge that denial. (d) The ammunition purchase permit shall be valid for one year from the date of issuance.


(g) The ammunition purchase permit shall be in a tamper-proof form prescribed by the department and shall include the name, address, photograph, date of birth, a unique identifying number, expiration date from the date of issuance, physical characteristics, including the height, weight, eye color, and hair color of the permitholder, and other information that may be prescribed by the department.
