In a surprisingly 'under-the-radar' development, some Los Angeles County Courts have resorted to offering nearly one year extensions to motorists who seek extensions on their traffic tickets.
Requesting an extension is an option for California motorists who want to extend their 'promise to appear' arraignment date. In L.A. County, people can request an extension online or over the telephone. Generally, a one time six-week extension is given initially upon request. Motorists then have the option of going to the court clerk's window and requesting an additional extension. LibertyFight.com has recently become aware of two people who have requested a second extension is person at the court and both have been given court dates for 2014! One case was a 'talking on a cell-phone ticket' given in Azusa, Ca in July 2013. The defendant initially got a six week extension over the phone and then went in person to the courthouse to request another extension. The clerk said they were very backed up due to the furlough budget cuts and that a court date wasn't available until April 2014! Another identical situation was confirmed through a relative of mine, whose LA County traffic court date was also extended to 2014- nearly a year from the time the citation was issued.
This is one circumstance where the inefficiency of government can definitely work in ones favor. The first appearance for a traffic ticket, known as the 'arraignment', is where the defendant simply pleads guilty or not guilty. The case is then scheduled for trial. I should note that in California, motorists have a right to a TRIAL BY DECLARATION, (trial through the mail), which is a great option which saves the hassle of going in person to court. There is a good reason for always getting an extension on traffic tickets. In my experience, the likelihood of the prosecution witness (the cop) to remember you and to show up after nearly a year is greatly diminished. You have nothing to lose by extending this out as long as possible. I've always maintained that people who are 'in a hurry' to go to court immediately after being ticketed are in a hurry to lose. Although dragging a ticket out a year is no guarantee of victory and is not in itself a tactic or legal defense to the violation, it certainly can't hurt. Take advantage of this predator government's weaknesses and throw a wrench in their revenue schemes! Don't forget to show up for your arraignment date though, as that would be an entirely additional 'crime' of 'failure to appear'. In that case, a warrant will be issued for your arrest and fines increased to nearly $1000. Don't be stupid.
Also don't forget to take advantage of all your legal options and right to due process in traffic trials. Each state is different but all generally have a process in which you can invoke your rights and 'make it difficult' on your prosecution instead of merely bending over for them. One example of this is to subpoena evidence in the DISCOVERY PROCESS before trial such as demanding the cop's ticket book, notes, calibration records, certifications, etc. John Shanahan for example, the stubborn dissident who doesn't believe government has a legtimate cause to demand he wear a seatbelt, always demands a copy of the oath the officer swears to and uses that in his defense. They never reply and John always wins, we have documented all this in the archives. Many of the traffic laws are not about safety but rather just want to fleece the people with excessive fines and penalties for petty 'offenses' which harm no one.
I have won about 15 tickets since I learned how to properly fight tickets in 2001, including one in the California Superior Court of Appeals, in which a panel of three judges ruled for me and threw out a phony conviction for a speeding ticket. I did this without a lawyer. I encouraged countless friends and family members to do the same. Their friends and co-workers then started to do this, and they have won also. I can't even keep track of the victories anymore, but we have compiled ours in our traffic ticket archives. My 22 year old niece for example, who had zero knowledge or experience in these matters, beat the first three tickets she ever got: a stop sign ticket, a seat belt ticket, and a parking ticket. All it took on her part was a little grit and the simple desire to stand up against the revenue state. She pled not guilty, got several extensions, and went from there. Saving all that money on fees and increased insurance rates comes in handy for a young full time student with not much money to spare. LibertyFight.com was recently featured in a Pasadena newspaper after an 81-year old motorist named Harry got a red light camera ticket, fought it and credited LibertyFight.com with the know-how. He beat the ticket.(way to go Harry!) I had never even heard of Harry, I don't know him. A friend of mine had seen the news article and sent it to me. Many univesities, law firms, media outlets and government agencies visit our traffic ticket section regularly. This is extremely gratifying and I hope and encourage everyone to fight the revenue schemes. We all know that the economy is terrible and everyone needs to keep their hard-earned resources in their pockets instead of willingly handing them over to a corrupt, rotten evil government. The New York Times ran an article in 2012 titled Go to Trial: Crash the Justice System featuring Susan Burton of A New Way of Life Reentry Project, which is described on their website as "a non-profit organization in South Central Los Angeles with a core mission to help women and girls break the cycle of entrapment in the criminal justice system and lead healthy and satisfying lives."
