Motorcyclist Records Obnoxious CHP Cop & Teaches Californians How To Get A Copy Of the Police Dashcam By Martin Hill
LibertyFight.com November 25, 2013
The following is a very interesting video which was sent to me a while back by the gentleman who recorded it and posted it to youtube. He was riding his motorcycle and was stopped by a CHP officer in Altadena (L.A. County), who cited him for an obstructed license plate. In the process of the traffic stop, the man began recording the interaction. The CHP cop, whose name is Officer Malone (ID# 14187), then told the man, in an extremely obnoxious manner, that it was illegal to record and "you can go to jail for that." The cop, who uses the phrase "Let me explain something to you" in a condescending manner about ten times in the video, goes on to tell the motorist "It's illegal for you to record conversation without my permission, and without notifying me. You didn't ask my permission, and you just notified me AFTER you started recording the conversation. Don't argue about it. If you want to argue about it I can just arrest you."
This video is particularly interesting because it begins with the dashcam footage from the CHP car itself, and then intersperses the actual footage recorded by the motorcyclist. The man who posted the video informs Californians how he got a copy of the dash cam. and how they can do the same. Apparently it's no easy feat to find out how to do that. It's not generally known as to how motorists can get a copy of the dash cam. Now, hopefully, many more people in California will know how to do this and will exercise their rights. Make the 'public servants' (revenue agents) and their supervisory apparatus do their jobs! Essentially, all these government workers with their undeserved bloated salaries are welfare recipients anyway, making their living off the backs of real hard working taxpayers.
The motorcyclist notes that he filed a public records request known as "CHP 370C" to get the dash cam, and also a "Citizens' Complaint" form, know as "CHP 240B." Form 240B is available here http://www.chp.ca.gov/publications/ under the Complaints/ Suggestions category. But interestingy, the form needed to get a copy of the cop's dashcam is nowhere to be found on the CHP website.
The motorist also notes the outcome of his complaint against the officer- that the officer was found to be 'in error' regarding his claim that it was illegal to record officers in public.
Below is a partial transcript of the video, along with the video itself and the poster's original description. The video, entitled It's not illegal to record the Police, Officer!!!, and posted by 'Guicci007,' currently has 106,118 views, 635 likes, and 45 dislikes. Be sure to also visit the LibertyFight.com Filming Cops Archives, which outlines all the major legal cases on this matter, and view our numerous interactions filming police below. [In 2008, I filed a complaint against a detective who tried to coerce me into stop filming police, after I had seen cops push down a small kid outside a retail store. I then recorded the police internal affairs interview, during which the investigators confirmed countless times that it is 100% legal to film police. That interview can be seen here; Full details here.] I can also personally attest that filming obnoxious cops & putting them on youtube can be an extremely lucrative avocation, particularly for doing practically nothing. I don't know if google wants members to release the numbers, but I heartily suggest that people do it if they want EASY residual income for years on end. :-)

Cop: Let me explain something to you. What are you recording?
Cop: Let me explain something to you. You can go to jail for that.
Motorist: "...I dont think the supreme court decision of Devenpeck v Alford..."
Cop: (Interrupting) Let me explain something to you. It's illegal for you to record conversation without my permission, and without notifying me... you didnt ask my permission and you just notified me AFTER you started recording the conversation... Don't argue about it. If you want to argue about it I can just arrest you.
I hope this helps educate all of us in one way or another, and make these overzealous police officers (that for either lack of knowledge, or power hunger), realize the Power is with the People. To THE PEOPLE, learn about your rights, don't fight it on the streets, fight it in the courts. KEEP RECORDING!!!......
